Please read these terms and conditions carefully before using our construction and real estate services
1. Agreement to Terms
By accessing our website, engaging our services, or entering into any agreement with HEXAS ENTERPRICES ("we," "us," or "our"), you agree to be bound by these Terms & Conditions and all applicable laws and regulations in India. If you do not agree with any of these terms, you must not use our services.
These terms apply to all clients, visitors, and users of our construction and real estate services, including residential construction, commercial construction, property development, and real estate consulting.
2. Services Description
HEXAS ENTERPRICES provides the following services:
- Residential Construction: Design, planning, and construction of residential buildings, villas, and apartments
- Commercial Construction: Construction of commercial buildings, offices, retail spaces, and industrial facilities
- Property Development: Land development, project planning, and property management services
- Real Estate Consulting: Property advisory, legal documentation, property valuation, and transaction support
All services are subject to separate written agreements that specify project scope, timelines, costs, and other terms specific to each engagement.
3. Project Agreements and Contracts
All construction projects and real estate transactions require a formal written agreement that includes:
- Detailed project scope and specifications
- Total project cost and payment schedule
- Project timeline and milestones
- Quality standards and materials to be used
- Warranty terms and after-service support
- Liability and insurance provisions
- Dispute resolution procedures
Important Notice
No work will commence until a signed agreement is in place and initial payment (as specified in the agreement) has been received.
4. Payments and Pricing
Payment terms are specified in individual project agreements. General payment terms include:
- All prices are quoted in Indian Rupees (INR) unless otherwise specified
- Payment schedules are typically milestone-based for construction projects
- Advance payments may be required before project commencement
- Late payment charges may apply for overdue amounts
- All payments must be made through agreed methods (cheque, bank transfer, or online payment)
- GST and other applicable taxes will be charged as per Indian tax laws
We reserve the right to suspend work if payments are not received as per the agreed schedule.

- Performing work in accordance with agreed specifications and quality standards
- Completing projects within agreed timelines (subject to force majeure events)
- Using quality materials as specified in the agreement
- Complying with applicable building codes, safety regulations, and environmental laws
- Maintaining appropriate insurance coverage
- Providing warranty for workmanship and materials as specified in the agreement
- Maintaining transparency in all dealings and providing regular project updates
7. Property and Real Estate Transactions
For real estate services, the following terms apply:
- All property transactions are subject to verification of title, encumbrances, and legal clearances
- Clients must conduct their own due diligence or engage independent legal advisors
- We act as consultants and facilitators; we are not responsible for title defects or legal issues
- Property prices, terms, and conditions are subject to negotiation between parties
- Registration and stamp duty charges are separate and payable by the parties as per applicable laws
- All property transactions must comply with the Real Estate (Regulation and Development) Act, 2016 (RERA) and other applicable laws
8. Warranties and Guarantees
We provide warranties for our construction work as follows:
- Workmanship Warranty: Typically 1-2 years from project completion, covering defects in workmanship
- Material Warranty: As provided by material manufacturers and suppliers
- Structural Warranty: As per applicable building codes and regulations
Warranty terms are specified in individual project agreements. Warranties do not cover:
- Damage due to natural disasters, accidents, or misuse
- Modifications made by the client without our approval
- Normal wear and tear
- Issues arising from client-provided materials or designs
9. Delays and Force Majeure
Project timelines may be affected by:
- Delays in obtaining permits and approvals from authorities
- Unforeseen site conditions or geological issues
- Weather conditions, natural disasters, or acts of God
- Government regulations, policy changes, or lockdowns
- Shortages of materials or labor
- Client-requested changes or delays in decision-making
We are not liable for delays caused by force majeure events or circumstances beyond our reasonable control.
10. Intellectual Property Rights
All designs, plans, drawings, and specifications created by us remain our intellectual property unless otherwise agreed in writing. Clients receive a license to use these materials for the specific project only.
You may not copy, modify, or use our designs for other projects without our written permission.
11. Limitation of Liability
Our liability is limited as follows:
- Our total liability for any claim shall not exceed the total project value or the amount paid by the client, whichever is less
- We are not liable for indirect, consequential, or incidental damages
- We are not liable for delays or issues caused by third parties, government authorities, or force majeure events
- For real estate consulting, we are not liable for title defects, legal issues, or property value fluctuations
This limitation does not affect your statutory rights as a consumer under Indian law.
12. Disclaimers
While we strive to provide accurate information and quality services:
We do not guarantee that:
- Property values will appreciate or remain stable
- All properties are free from legal encumbrances (clients must conduct due diligence)
- Construction timelines will be met in all circumstances
- Website information is always current or complete
13. Indemnification
You agree to indemnify and hold HEXAS ENTERPRICES harmless from any claims, damages, losses, or expenses arising from:
- Your breach of these terms or project agreements
- Your violation of any laws or regulations
- Your provision of inaccurate information
- Issues with property title or legal clearances
14. Termination
Either party may terminate a project agreement:
- By mutual written consent
- If the other party breaches material terms and fails to remedy within a specified period
- For convenience, subject to payment for work completed and termination charges as specified in the agreement
Upon termination, clients must pay for all work completed, materials ordered, and reasonable termination costs.
15. Dispute Resolution
In case of disputes:
- Negotiation: Parties will first attempt to resolve disputes through good faith negotiation
- Mediation: If negotiation fails, disputes may be referred to mediation
- Arbitration: Disputes may be resolved through arbitration under the Arbitration and Conciliation Act, 2015
- Jurisdiction: Courts in Hyderabad, Telangana, India shall have exclusive jurisdiction
16. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Hyderabad, Telangana, India.
17. Changes to Terms
We reserve the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified terms.
For existing projects, the terms in the signed project agreement will continue to apply unless both parties agree to modifications.
